Legislative Update - Contact your Legislators re: Landlord.Tenant Bills

This NH Landlord News Update has been produced by Nick Norman,  Director of NH Landlord/Tenant Legislative Affairs

Important Updates:
SB135, Lead Law
Bill text for the Lead Law is now released.  We will probably have about one week to review and study the bill. We plan to finish our analysis this week.  If you would like copies of the Lead Law or any other proposed amendments, please contact Nick Norman at nicknorman@yahoo.com.
 

Current Status of Landlord Bills

Important Landlord bills are being decided.  We need your input to legislators to ask them to vote in our favor.
 
The following bills will likely be decided by the committee this week.  We have amended the bills based on testimony at the hearings. 
  • HB203, Representation Landlord/Tenant Court
  • HB315, 7 Days Eviction Notice In Certain Circumstances
  • HB309, Removal of Tenants Property
  •  HB269, First, Last Month’s Rent & Security Deposit. This bill has been voted “Inexpedient to Legislate” by the committee.  Which means they recommend killing the bill. If you want to keep the bill contact your representatives and ask them to support passing the bill when it comes to a vote on the entire House floor.

There is a very strong opposition to this bill.  We need to show up very strong for it if we are going to get it to pass.
 
The current statute that governs security deposits, RSA 540-A:6 only permits a landlord to collect a security deposit of one month’s rent or $100, whichever is greater. A landlord can collect the first month’s rent but not the last month’s rent.  HB 269 would permit a landlord to collect the first and last month’s rent, and a security deposit equal to one month’s rent.  Basically, a tenant would have to come up with three month’s rent to move into an apartment. A written statement by the landlord regarding the last month’s rent would be required.  This is law in Mass now & standard practice in many states.
 
Under current law, if a tenant decides to use the security deposit as his or her last month’s rent, even if it is a violation of  the lease, the landlord has little recourse other than to evict the tenant,  spending money that will not be gotten back and angering the tenant who may further damage the apt.  Evictions take more than a month & the tenant usually has vacated by that time.  This scenario leaves the landlord with no security deposit to cover damages to the apartment.
 
With out the ability to collect last month’s rent, landlords have to be more careful in accepting tenants, which forces tenants with either bad rental history or no rental history to live in inferior buildings or neighborhoods.
 
We believe this will help prevent tenants from using their SD for the last month’s rent, then leaving the landlord footing the bill for an apt in terrible condition.
 
The bill does not mandate landlords to collect last month’s rent but simply allows for it if the landlord feels the need for extra protection.
 
Allowing upfront collection of last month’s rent would also provide another method for a tenant having trouble getting an apartment to relieve some of the financial concern of the landlord and possibly allow a tenant with rental application defects to secure an apartment.
 
Tenant groups will oppose it, as over half the people in the United States have less than $500 in reserves. (They live paycheck to paycheck).  Tenant groups will argue that his bill will make it very difficult for many people to rent apartments if they had to pay an amount equal to three months’ rent in advance. In addition, social service agencies simply do not have the funds to aid people with more than a month’s rent as security deposit.  However, as stated above collection of last month’s rent is only option and not mandated.  Our experience in the present market is that it is hard to collect even 1st month and security deposit.  Therefore, the likely scenario is that the last month option would only be used when the tenant is attempting to offset their rental application defect and the have the money to do it.
 
Another option could be contractually having the tenant pay the last month’s rent in installments with the ability to evict for non-payment of this payment plan.

Gold and silver can simply be exchanged at local dealers so that accepted currency can be used for transactions.   Average person will not have the means to determine the weight and quality.

Talking Points:
The bill would apply 5% I/D tax to Trusts, Partnerships, LLC's and associations to interest and dividends above $5k threshold.  Trusts used for estate planning purposes have been attractive to NH residents. In the past I/D tax has only been imposed on distributions to trust beneficiaries.
Because this bill does make major changes in the New Hampshire tax system, and does affect all of us, we need to follow this bill.  However, a correct analysis needs to be done by someone with knowledge of the existing tax and how this changes things.
 
For residents of New Hampshire with capital gains, those gains will be subject to a state tax.  Yes, this is an income tax, but on unearned income.
 
Because of our lack of expertise in this area, and that the bill affects everyone and not just landlords. Until someone can do a deeper analysis we recommend you decide.

Reducing our property taxes for one year in the short term would be nice & any form of tax relief is long overdue.  Longer term tax relief will encourage investment in this state.
 
However, not knowing enough about the state’s finances, or if there are other plans for the tobacco settlement funds, such as funding medical expenses for smokers who become ill and cannot pay these bills, it is impossible to make a judgment if this bill is a good idea.
 
This additional revenue should be returned to property owners who bare the burden of education funding.

Talking Points:
This bill, if enacted, would marginally clarify what is price or consideration to base the amount of tax to be paid in real estate transactions.  Currently, non-contractual transfers, which basically are gifts, are not taxed.  The bill would add to the definition of price and consideration, which the amount of the taxes to be paid are based upon, the words “in a contractual transfer.” The bill is merely housekeeping, and does not change anything.
 
This bill will help the banks when they take a deed in lieu of foreclosure. They won’t have to pay the transfer stamps. This would be a good bill to amend transferring a property in to another entity for estate planning/asset protection. Not having to pay transfer stamps if it is still done for the above reasons.

One of our analysis team put together this info:
There are bills attempting to eliminate RGGI. The fiscal impact statement of that bill, HB208, says it all. It is very expensive. The money saved comes from our pockets. Government never generates revenue, they take it from the citizens.
 
The biggest greenhouse gas is water vapor. That is 95 percent of all greenhouse gases. All the other greenhouse gases (including CO2) make up the remaining 5%.  We can do very little to control the water vapor.

RGGI is a cap-and trade system for reducing co2 from power plants. Auctioning began in 2008.
 
FISCAL IMPACT:
        The Public Utilities Commission and the Department of Environmental Services state this bill, as introduced, will decrease state restricted revenue and expenditures by $8,000,000 in FY 2015, $20,500,000 in FY 2016, $25,500,000 in FY 2017, $28,000,000 in FY 2018, and $28,000,000 in FY 2019, and decrease local revenue by $2,000,000 in FY 2015 and each year thereafter. This bill may have an indeterminable fiscal impact impact on county and local expenditures, and county revenues.
 
Here is a varying opinion:
Funds from these auctions pay for energy efficient programs such as weatherization of homes.
Bills have been introduced to pull out of this initiative all together as NJ has done. However, NH receives about 18million/ year in carbon allowances. Most is paid out in ratepayer rebates, with the remainder used for weatherizing homes.
 
NH has one of the highest electric rates of the country. This will not only drive away company investment in NH but also it's residents.
