==Legislative Update, 2017 #04== The new Lead bill informational landlord only sessions. Many other bills scheduled for hearings this week.

Howdee everyone,

Important Updates:
Please note that the new lead bill, which is by far the most important bill of this season, is expected to have final draft complete and to me with in a couple days.  We are attempting to get this version into the legislative process from the beginning.  However, we don’t know if the final draft can be substituted for the original bill at this date.  So please don’t pay too much attention to the initial bill that will be on line soon until you hear from us to know if it is the commission’s final draft.  This final draft will have a large rewrite of the landlord/tenant sections of the bill which has become much more friendly than the original bill.  If the original bill is not substituted then we plan to bring the final draft to the legislative hearing.

The new lead bill is very large, complex and has many interconnected parts.  The commission members have worked very hard at coming up with something that all sides can accept.

We are planning to host several landlord only informational sessions to give an advance look at the bill language, explain the bill and prepare for legislative hearings and contacting legislators.

We plan to cover:
what the lead law is now,
what the long distance future looks like,
overview of the actual bill language (note as of 1/29/17 it is not released on the NH government website),
what is surprisingly favorable and very flexible to landlords,
what we would likely object to,
opportunity to collect your thoughts and bring them back to the lead commission,
contacting legislators & attending the legislative hearing,
opportunity for a long question answer session.

Please join us and become knowledgeable on this enormous & very important bill.

HB150, Property and Casualty Insurance
01/12/2017 at 01:15 PM    LOB Room 302
Title: Title: relative to property and casualty insurance.

Summary: This is a bill that amends the statute for property and casualty insurance.  It seems to have little impact on us.

Property Owner Position: You decide

Email to Committee:
Subject: HB150

Analysis Stated in Bill:

HB129, Repealing the Education Tax Credit
01/12/2017 at 02:15 PM    LOB Room 207
Title: Title: repealing the education tax credit.

Summary: Remove education/scholarship tax credit against business profits tax.

Property Owner Position: Against

Email to Committee:
Subject: HB129

Analysis Stated in Bill:

Talking Points:
While we see this as a small impact bill, we also would oppose  anything that would increase the effect of the Business Profits Tax.  According to the Fiscal Note at the bottom of the bill, the tax credit to be repealed is an offset of BET or BPT for scholarships. The amount deducted over the last few years has been miminal (Highest year $115,000). RE companies could use this decuction as an effective tool to assist personnel .

HB78, Increase penalties for violating property and casualty laws
01/12/2017 at 03:15 PM    LOB Room 302
Title: Title: relative to penalties for violating the insurance laws regarding property and casualty insurance.

Summary: The bill substantially increases fines set forthin RSA 412:40

Property Owner Position: Against

Email to Committee:
Subject: HB78

Analysis Stated in Bill:

Talking Points:
Here is the entire bill.
"The commissioner, may upon a finding that any person or organization has violated any provisions of this chapter, impose a penalty of not less than [$500] $10,000 or more than [$10,000] $40,000 for each violation, but if the violation is found to be willful, a penalty of not less than [$1,000] $30,000 or more than [$25,000] $75,000 may be imposed for each violation. Separate penalties may be in addition to any other penalty provided by law. "

This is a very large increase, especially on the low end.  What about a minor infraction, now the minimum is $10000?  The RSA 412 is very long with lot of rules to understand and therefore easy to miss one.

HB297, Repealing The Education Tax Credit
01/17/2017 at 03:15 PM    LOB Room 207
Title: Title: repealing the education tax credit program.

HB501, Access To Minutes Of Meetings Of Condominium Unit Owner's Associations
01/31/2017 at 10:15 AM    LOB Room 302
Title: Title: relative to access to minutes of meetings of condominium unit owner's associations.

Summary: The bill would require all condo associations to take minutes of all meeting held, and make the minutes available within 15 days to any condo owner

Property Owner Position: For

Email to Committee:
Subject: HB501

Analysis Stated in Bill:

Talking Points:
There is no reason why condo owners should not have access to meeting minutes, especially since his or her finances and investment are directly affected by the actions of the condo associations.  This provide transparency and  helps owners know what went on without attending the meetings.

Unfortunately there is no enforcement mechanism if the law is not followed. The condo association could ignore any request.
=====================
HB502, Condo Financial Information Available To Unit Owners
01/31/2017 at 10:45 AM    LOB Room 302
Title: Title: relative to the availability of condominium financial information to unit owners.

Summary: Financial Information shall be provided within 15 days of request and 30 days prior to annual meeting.  Unit owners shall have access to P&L salaries etc.

Property Owner Position: For

Email to Committee:
Subject: HB502

Analysis Stated in Bill:

Talking Points:
This provides more transparency.  There is no reason why condo owners should be prevented from access to the financial information of the condo association.  After all, some of the funds come from that owner, and how the funds are spent affects that owner.

Unfortunately there is no enforcement mechanism if the law is not followed. The condo association could ignore any request.
=====================
HB568, Taxability Of Lease Interests In Public Property
01/31/2017 at 11:40 AM    LOB Room 301
Title: Title: relative to the taxability of lease interests in public property.

Summary: Seems to have little impact on landlords.

Property Owner Position: You Decide

HB385, Requires Foreclosure Notice Certified Mail Receipt Requested
01/31/2017 at 01:15 PM    LOB Room 302
Title: Title: relative to notice for foreclosures.

Summary: This bill would require that a mortgagee send notice of foreclosure to the mortgagor registered or certified mail return receipt required.

Property Owner Position: For

Email to Committee:
Subject: HB385

Analysis Stated in Bill:

Talking Points:
The idea is to make sure that the mortgagor has actual knowledge, as much as it possible, of the foreclosure proceedings.  This would provide the mortgagee at least the opportunity to try to avoid the foreclosure.
=====================
HB566, Repealing The Community Revitalization Tax Relief Incentive
01/31/2017 at 01:30 PM    LOB Room 202
Title: Title: repealing the community revitalization tax relief incentive.

Summary: This bill would eliminate 79E tax incentive programs, where cities
and towns can give tax incentives for improvements of properties during the rehab work

Property Owner Position: Against

Email to Committee:
Subject: HB566

Analysis Stated in Bill:

Talking Points:
The tax incentive that this bill would eliminate does give incentive to developers to rehabilitate blighted areas.  Without doing a more thorough analysis of the bill it is believed the tax relief to the developer is temporary by not raising the tax assessment  (because of the new improvements) for a few years.  Therefore, this would not affect other property taxes but would encourage positive development for troubled properties and eventually increase the tax basis of this subject property and therefore causing a slight relief on taxes on the remaining properties in the town.

Some of our fellow landlords use the credit and to repeal it would be very bad.  RSA 79e is an excellent tool for towns or cities to encourage economic redevelopment of decrepit buildings, which would otherwise be left to continue to decay.
=====================
SB75, Tax Credit for Donations to Career and Tech Education Centers.
02/01/2017 at 09:00 AM    SH Room 100
Title: Title: establishing a tax credit against business profits taxes for donations to career and technical education centers.

Summary: Career and Technical education centers, under this bill, may accept donations of tangible personal property and up to 50% of apprenticeship and training programs for students in the program. Donors shall be allowed a credit against the business profits tax, but not more than 25% tax due from that donor.

Property Owner Position: For

Analysis Stated in Bill:

Talking Points:
The bill gives businesses a direct way to help pay for the training of employees in career and technical education centers. Donations can include payment of salary for the employee. It could promote the education of the New Hampshire workforce in specific areas.
=====================
SB80, Veterans Tax Credits
02/01/2017 at 09:00 AM    LOB Room 102
Title: Title: relative to implementation of the all veterans' tax credit.

Summary: The bill would give municipalities authority to phase out an older veteran's tax credit over three years and use the newer credit.

Property Owner Position: You Decide

Analysis Stated in Bill:

Talking Points:
This bill appears to be a house keeping bill, giving munipalites the ability
to change over the veteran's tax credits
=====================
SB76, Option To Rebate The Research And Development Tax Credit Against Business Profits Tax
02/01/2017 at 09:20 AM    SH Room 100
Title: Title: establishing an option to rebate the research and development tax credit against business profits taxes, and making an appropriation therefor.

Summary: Seems to have little impact on landlords.

Property Owner Position: You Decide

Analysis Stated in Bill:

Talking Points:
We have not studied this bill and are basically just letting you know this bill is here incase you think it may impact you.  If you learn more please let us know.

HB534, Reporting Of Meals And Rooms Tax Revenue By The Department Of Revenue
02/01/2017 at 09:30 AM    LOB Room 202
Title: Title: relative to reporting of meals and rooms tax revenue by the department of revenue administration.

Summary: Seems to have little impact on landlords.

Property Owner Position: You Decide

Email to Committee:
Subject: HB534

SB168, Increase Veterans Tax Credit from $500 to $1000
02/01/2017 at 09:30 AM    LOB Room 102
Title: Title: relative to increasing the maximum amount of the optional veterans tax credit.

Summary: The optional upper limit of the veterans tax credit would increase from
$500 to $1,000.

Property Owner Position: You Decide

Analysis Stated in Bill:

Talking Points:
The analysis team has varying opinions on this bill.
This is a bill that aids veterans and a thank you for your service from all of us.
If SB80 passes there will be more Vets applying for tax credits. Doubling the amount will unfairly increase the burden on remaining tax payers.
=====================
HB215, Marijuana Study Commission
02/01/2017 at 10:00 AM    LOB Room 202
Title: Title: establishing a commission to study the legalization, regulation, and taxation of marijuana.

Summary: Establish a commission to study the impact of legalization, regulation and taxation of marijuana without input from residential or commercial landlords.

Property Owner Position: For

Email to Committee:
Subject: HB215

Analysis Stated in Bill:

Talking Points:
Again many mixed thoughts on the analysis team which are included below.

It is inevitable marijuana will eventually become legal due to the way surrounding states treat this issue.
People already smoke it, its legal in ME and MA, why not develop some new tax revenue?

This is a gate way drug that we should not legalize. Make it a fine to be in possession of so much of it, de-criminalize it.

There are way too many people incarcerated for small marijuana related offenses

The only issue to landlords is the nuisance factor.  Odor will go to other apartments. We need something to allow landlords to react to complaints.  Could lead to new “sin tax” which could lower property tax.

Most of us are a least FOR studying the issue because it is obvious that it won’t go away so we might as well study it and hopefully come up with a reasonable plan for addressing it in NH and learning from other states that have gone before us.

We would like opportunity for landlord input on the commission.
=====================
SB186, Establish Commission To See If Stormwater Utility Fees Can Be Tax Deductible
02/01/2017 at 10:00 AM    SH Room 100
Title: Title: establishing a committee to study the tax characterization of stormwater utility fees.

Summary: The bill would establish a commission to study the recharactorizion of stormwater utility fees so that the fees are federal tax deductable

Property Owner Position: For

Analysis Stated in Bill:

Talking Points:
This bill would only effect those in communities that have stormwater utility charges, and have large enough properties to be taxed because of the property contributes run off to the storm drain system.  Since the fees are an actual out of pocket expense for the owner of such real estate, just like water and sewer bills, the fee should be deductible for the calculation of income taxes.

This fee may not be deductible against income tax presently.  This bill would study allowing a property owner to deduct this expense against their federal income tax.
=====================
HB644, Extending Interest and Dividends tax to Include Capital Gains
02/01/2017 at 10:30 AM    LOB Room 202
Title: Title: extending the interest and dividends tax to capital gains, increasing exemptions from the tax, and providing for retirement system contributions on behalf of employers other than the state.

Summary: The summary in the fiscal note accurately states: "This bill makes changes to the interest and dividends tax by including capital gains as taxable income and increasing the tax exemptions for the tax; creates the capital gains reserve fund; and reinstates the state contribution to political subdivisions for employer contributions for group I and group II members."

Property Owner Position: Against

Email to Committee:
Subject: HB644

Analysis Stated in Bill:

Talking Points:
There are some different thoughts on the analysis team.
Most are against the bill because it creates another hidden income tax.

For:
It will increase the exempt amount to $7500.  Also will bring back State contributions to NH Retirement which will lessen towns’ expense and theoretically lessen property taxes.

Distributions from a qualified retirement plan would not be subject to the tax.

Against:
Real estate investors, when they sell a building, could be easily subject to this additional tax, and that is why should oppose the bill.

The interest and dividend tax is a limited income tax, and one more type of income (capital gains)under this bill would be subject to taxes and thus a hidden income tax.

It will tax everyone that sells home at a profit  You already pay a transfer tax on the sale and purchase of your home or rental property.  Therefore, this bill would cause double taxation on the sale of your real property.
=====================
HB565, Collection Of Delinquent Property Tax Manufactured Home Owners
02/01/2017 at 11:20 AM    LOB Room 301
Title: Title: relative to collection of delinquent property tax payments by manufactured housing owners.

Summary: The bill empowers municipalities to set up a monthly plan for the payment of past due real estate taxes from mobile home owners. It also sets up for the monthly collection of subsequent year's taxes

Property Owner Position: You Decide

Email to Committee:
Subject: HB565

Analysis Stated in Bill:

Talking Points:
The adoption of the plan set up in the bill will require more labor on the part of the local tax collector office.  There is no provision for the payment of these costs.  The bill also does not include single family home owners who maybe in the same financially tight position as mobile home owners, or who cannot manage their finances.  It does give people a chance to save their homes from tax sale if they comply with the monthly payment schedule set up by the local tax collector.  Municipalities would have an option to use or not use this plan.

Talking Points:
Who is going to enforce this bill if it becomes law, and
who is going to pay for the costs of enforcement? Not the persons who lost the property in forclosure, as they are already broke.

HB654, Regulation and Rooms & Meals tax for short term rentals
02/01/2017 at 02:00 PM    LOB Room 302
Title: Title: relative to short-term and vacation rentals under the meals and rooms tax.

Summary: This is a detailed bill that would first stop municipalities from prohibiting short term rentals, but would allow the short term rentals to be subject building and similar codes, and would set up a system to allow entities that handle short term rentals to pay the rooms and meals tax on behalf of the property owner.

Subject: HB654

Talking Points:
Note the rooms and meals tax is already a requirement to be paid under present law and this bill does not change that fact.

The following description is listed in the bill purpose.
“Internet platforms are enabling more Americans to earn extra income from their homes and investment properties through short-term and vacation rentals.  At the same time, American travelers and family vacationers are saving money by renting fully-furnished homes instead of hotel rooms.  The growth of this new market is encountering resistance from many governments, in the form of zoning restrictions and prohibitions that prevent homeowners from using their residences for short-term rentals.  In 2016, Arizona enacted breakthrough legislation that enables short-term rentals while increasing tax revenue and preserving limited local regulation.  The Arizona law stops local governments from prohibiting short-term rentals, while allowing local enforcement of regulations on parking and public safety.  This law also makes taxes more efficient by allowing online platforms to collect and pay taxes at the state level, relieving homeowners of the need to file individually.”

The bill would allow the use of rooms in a home for short term rentals, and would subject the room or other lodging to be up to housing standards.   Taxing the rooms would help level the playing field for hotels, as they have to charge the tax and are at a price disadvantage with the short term renters, as well as put more funds in the state treasury.  It also specifically allows on line platforms that handle short term room rentals to handle the rooms and meals tax which is supposed to be paid under existing law.

HB399, Pesticide Use Where Children Play
02/07/2017 at 10:00 AM    LOB Room 303
Title: Title: relative to pesticide use and notification in places where children play.

Summary: From the Analysis summary of the bill:
“This bill restricts the use of pesticides in places where children play to situations in which alternative methods have been exhausted and the pesticide application is deemed necessary based on an imminent threat to public health.  The bill also establishes notice requirements regarding any emergency pesticide application”  The bill specifically relates property “which is owned or controlled by the state of New Hampshire or any county, city, or town in the state”

Subject: HB399

Analysis Stated in Bill:

Talking Points:
The intent of the bill is to prevent children's exposure to pesticides used in schools, day care, and playgrounds.  The bill also specifically relates property “which is owned or controlled by the state of New Hampshire or any county, city, or town in the state”.

The bill specifically defines a lawn care pesticide and says that an individual may not apply a lawn care pesticide to a playground except in the case of an emergency pesticide application “which is to be determined by county, city, or town board of health, or for a municipality not having a board of health, the governing body of the municipality shall select a designated health official.”

A concern expressed by the analysis team is that while the intent of the bill sounds good usually legislation like this drives up costs for everyone.

Additionally, a deeper knowledge of pesticides would be needed to comment more thoroughly on the bill and we don’t have that expertise.  For instance, still allowed would be “A pesticide including no active ingredients other than those published in the National List at 7 C.F.R 205.601, as amended.”  We’re not sure what that would mean.
